1. Scope

These Terms and Conditions govern the sale of products through this website by Simani Industrie S.r.l., an Italian company.

The contract is governed by Italian law and applicable European Union consumer protection regulations.

2. Contract Conclusion

The purchase contract is concluded upon receipt of the order confirmation email.

Simani reserves the right to refuse orders in case of:

product unavailability
pricing errors
suspected fraudulent activity

3. Prices

All prices are in Euro and include VAT unless otherwise specified.

Shipping costs are displayed before checkout.

4. Payments

Accepted payment methods are those displayed at checkout.

6. Right of Withdrawal (EU & UK Customers)

If you are a consumer residing in the European Union or United Kingdom, you have the right to withdraw from the contract within 14 calendar days of receiving the goods.

7. No Right of Withdrawal – Custom Products

The right of withdrawal does not apply to:

personalized products
custom-made garments
items embroidered or printed upon customer request

In accordance with Article 59 of the Italian Consumer Code and applicable EU consumer law.

8. Warranty

Products are covered by a 24-month legal guarantee of conformity for EU consumers.

For UK and US customers, statutory consumer rights apply under applicable local law.

9. Limitation of Liability

Simani shall not be liable for indirect damages resulting from improper use of products.

Nothing in these terms excludes mandatory consumer rights.

10. Online Dispute Resolution (EU)

EU consumers may use the ODR platform:

11. Governing Law and Jurisdiction

These Terms are governed by Italian law.

For EU consumers, jurisdiction lies with the court of the consumer’s place of residence.

For non-EU customers, the Court of Lucca (Italy) shall have exclusive jurisdiction.
